====== 明細書の記載要件 ======

　明細書の記載要件違反による拒絶は、米国特許法[[112a|第112条(a)]]または[[112b|(b)]]（35 U.S.C. 112(a), (b)）を根拠としてなされます。

"(a) IN GENERAL.-  The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention.\\
(b) CONCLUSION.-  The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor  regards as his invention."

　[[112a|112条(a)]]は、明細書には、発明およびその製造や使用の方法を、当業者にとって製造および使用できるように、完全、明瞭、簡潔かつ正確な用語で記載しなければならず、発明者が最良と考える実施態様を記載しなければならない旨規定しています。\\
　[[112b|112条(b)]]は、出願人が自己の発明であると考える主題を特定的に指示し且つ明確に主張する1以上のクレームで、明細書は終結しなければならない旨規定しています。
